Chapter I Membership SECTION 1 SECTION 2 – ELIGIBILITY REQUIREMENTS Regular Membership will be open to all active duty uniformed personnel, (including active duty reservists), and their dependents, to dependents of deceased military, and to all retired personnel of the Armed Forces of the United States and their dependents as defined in the Armed Services Exchange Regulations published by the Secretary of Defense, and all active or retired DOD personnel.Associate Membership will be open to those honorably discharged armed services individuals, inactive Reserve and Merchant Marine personnel who do not meet the requirements of Regular Membership but who support the objectives of the Santa Margarita Yacht Club of Camp Pendleton, California, and the U. S. Naval Sailing Association. Associate Members have all of the privileges of Regular Members, except they may not participate in activities funded solely by non-appropriated or Marine Corps Community Services funds. Associate membership may not constitute more than forty-five percent of the total membership of the club. Lifetime Memberships may be bestowed upon those members whose service to the Club is of such a distinguished nature that they are recognized as having made a significant and lasting contribution to the Santa Margarita Yacht Club of Camp Pendleton, California, for a continuing period of time. Such persons may be nominated for a Lifetime Membership. Nominees will be voted on by the Board of Directors only once each year at the September Board of Directors meeting. A two-thirds vote of the board is required to approve a Lifetime Member, and only one member may be voted into this category per year. Lifetime Members retain all the privileges of membership, and are exempt from paying dues. Junior Membership with its specific requirements, responsibilities, and benefits will be established when required. Honorary Membership may be extended by the Board of Directors to honor or recognize certain individuals. Honorary Membership is for one year and may be renewed by the Board of Directors. Honorary Members share in all of the privileges of Regular Members, but may not vote or hold elective office, and are not required to pay dues.
SECTION 3 – PARTICIPATION All classes of members are entitled and encouraged to participate in Club activities, social events, and to fly the Club Burgee. Only Regular Members, Associate Members, and Lifetime Members may vote or hold elective office. SECTION 4 – APPLICATION FOR MEMBERSHIP Application for Regular or Associate Membership will be made in writing to the Chairman of the Membership Committee. The application for Regular membership must be accompanied by a copy of the applicant’s government identification card. Application for Associate Membership must be accompanied by a copy of the applicant’s DD 214. The Membership Chairman shall verify that the applicant is eligible for membership and present the application to the Board for consideration and disposition. SECTION 5 Membership discrimination based on race, color, national origin, religion, sex, or age shall not be permitted. Chapter II - Dues SECTION 1 – MEMBERSHIP DUES Annual membership dues are $50.00 for a calendar year, and are due and payable by December 31 of the preceding year. New members’ dues shall be $50.00 upon joining at any time of the year up through the end of September. Those joining in the months of October, November, and December shall pay $50.00 and be considered paid up through the following year. SECTION 2 – DELINQUENT DUES Members who do not pay their dues by January 31 will be reported by the Treasurer to the Board of Directors as delinquent at the February meeting. The membership chairman will be instructed to notify such members that they are delinquent. Delinquent members are not allowed to vote, hold office, or participate in membership meetings. They will not be listed in the Club Directory nor will they continue to receive the news letter. Delinquent members will be able to reinstate to full member status by clearing their indebtedness if such action is accomplished during the same year in which they become delinquent. After that time they may rejoin the Club by submitting a new application. SECTION 3 – GENERAL MEMBERSHIP CHANGES The Board of Directors will recommend to the general membership changes in dues as they become necessary for responsible operation of the Club. The Board’s recommendation will be published in the newsletter prior to the next general membership meeting. Voting on these recommendations will take place at said meeting. Chapter III – Discipline SECTION 1 A member may be expelled or suspended from membership in the Club for conduct injurious to the welfare or the economic wellbeing of the Club. Upon written complaint of one or more members, the Board shall investigate the circumstances connected with such alleged misconduct, and if, in their opinion, the charges are sustained, they may expel or suspend the member complained of, provided that such member shall be notified to appear before the Board to defend himself/herself before any punishment shall be valid. Chapter IV – Resignations And Reinstatements SECTION 1 – ABSENTEE MEMBERSHIP Members in good standing, who for reason of military service depart the Southern California area for a period of at least four months, and who do not maintain a boat in the area, may retain membership in the Club by paying one-half the current dues annually. If such members return to the area or return a boat to the area, they may be reinstalled to full-time membership by paying the full amount of annual dues. SECTION 2 – RESIGNATIONS Any member in good standing may resign without prejudice upon giving written notice to the Board of Directors. Such members, who are still eligible, shall be entitled to re-instate their membership after submitting an application to the Board of Directors. SECTION 3 – REINSTATEMENT Individuals who have been expelled or suspended for disciplinary reasons may apply in writing to the Board of Directors for re-instatement. The Board will consider each request on a case by case basis. Chapter V - Order of Business SECTION 1 -The order of business at regular meetings shall be:
SECTION 2 – ALL OTHER PROCEDURE All questions of procedure not covered by the By-Laws shall be determined in accordance with Robert’s Rules of Order. Chapter VI – Amendments These By-Laws may be amended at any meeting by a majority vote of the voting members present at such meeting. Chapter VII – Boards and Committees SECTION 1 - APPOINTMENTS Two types of appointed Boards and established. Standing Boards of Committees are of a permanent nature and will function on a continuing basis. One-half of the membership of each of these boards and committees will be appointed each year to hold office for a period of two years. In addition, the Board of Directors shall appoint a Chairman of each annually. SECTION 2 – EDUCATION AND SAFETY The education and Safety Board will be a standing board. Its primary function is to prepare instructions, manuals, courses, and demonstrations in water safety, boating, and seamanship. SECTION 3 – RACE COMMITTEE The Race Committee shall be a standing committee. It shall assume charge of all race schedules, provide the necessary judges and other officers, and the necessary stake boats, buoys and marks for designation of courses. It shall furnish captains of boats entered for a race with full information concerning the start, the course and the finish. It shall compile, record, and maintain data on all races. SECTION 4 – PROGRAM COMMITTEE The Program Committee shall be a standing committee. It shall be in charge of the entertainment given by the Club. It shall provide accommodation for visiting yachts and guests of the Club at any of its races, cruises, or social events. It shall not obligate the Club in any way or make expenditures of the Club’s funds without express authority from the Board of Directors in each case. Chapter VIII – Junior Division Detailed organizational and operating procedures for a Junior Division will be established when the need arises. Chapter IX – Club Facilities To be published at a later date. Chapter X – Private Boats It is the responsibility of boat owners to maintain their boats in a seamanship fashion. All private boats shall be properly registered or documented and fly the Club burgee when operating in or about the Del Mar Basin. Chapter XI – Implementary Rules The Board of Directors will propose further implementing rules from time to time which shall be considered for adoption as By-Laws at future general meetings of the Club. |
